The Government of Nebraska is guarded and established by the Nebraska Constitution. Nebraska became a 37th state of the United States on March 1, 1867 [1]. The state is also nicknamed as the “Corn husker State”. The government of Nebraska is divided into three distinct branches, namely the Executive branch, the Legislative branch and the Judicial branch.

Nebraska Executive Branch


The Nebraska Executive Branch is a well functioning body of the government of Nebraska and several state government departments work under the executive branch. The Governor of Nebraska leads the government as well as the state as the chief executive head. The governor may serve the State for a four year term. The governor of the state must be minimum 30 years of age and a the state's citizen and resident for 5 years prior to election.

The Lieutenant governor may exercise the governor’s duties only in situations when the governor is incapable of performing his/her duties. Based on whether he/she is a member of the cabinet of the governor, executive authority may or may not be rendered to the lieutenant governor. The lieutenant governor is also elected for a four year term.

The other elected executive officials are the Attorney General, the Secretary of State, the State Treasurer, and the State Auditor.

Attorney General


The Attorney General of the State of New York is the highest ranking law enforcement officer for the state. He/she is the head of the Department of Law, and is regarded as the State's chief legal officer.

Secretary of State

State Treasurer


The State Treasurer is responsible to efficiently manage the finances and public resources. The Treasurer also has the responsibility to overview cash management, debt management, pension funds etc. of the state

The State Auditor is responsible to handle timely and accurate audits and investigates all financial handlings and dealings of the state and local governments of Nebraska.

Nebraska Legislative Branch


Nebraska has a unique legislature called a unicameral legislature, a single house system. Nebraska is the only state in the nation to follow such legislature. The house is more popularly known as "Unicameral" though officially referred as the "Legislature". As it is unicameral, the house comprises of the senators only. A 3/4th majority is required to override a governor's veto. The state legislature holds meetings in the Nebraska State Capitol building, located in Lincoln.

The Nebraska legislature has 49 senators who are led by the Speaker. The members are elected trough non-partisan elections, selected by a single-member constituency or district. Each senators may serve for a four-year term and half of the seats are elected every second year. The speaker of the House is the presiding officer of the assembly who is elected by the members of the house through a House resolution. It is a leadership position and he/she must administer the majority party agenda and delegate the duty to the members of the house.

Nebraska Judicial System


Under the Nebraska Constitution, the Judiciary branch applies and interprets laws and regulations to ensure justice in the state. The Nebraska judicial system is unified and enacts the Missouri Plan to select judges of all levels. The judicial system of Nebraska is divided into the Supreme Court, Court of Appeals, district courts, and county courts.Judiciary

  • The separate juvenile courts - Located in Douglas, Lancaster
  • Sarpy Counties - A statewide Workers’ Compensation Court

Nebraska Supreme Court


The Supreme Court is the highest court of appeal. The court comprises of a Chief Justice and 6 associate justices. The governor of the state appoints each justice based on the Missouri Plan and the justices undergo a retention vote for extra term of 6 years. The Chief Justice leads the Nebraska Judiciary system at large. The judicial nominating commission prepares a statewide list of candidates for the position of chief justice and the governor selects and appoints a chief justice from that list. The main and most basic responsibilities of the Supreme Court are to handle appeals and lead the state judicial system as an administrative leader.

Responsibilities of the Supreme Court-

  • The Supreme Court handles major appellate cases related to death penalty, constitutional questions or the life imprisonment sentence.
  • The Supreme Court also regulates the practice of law in Nebraska. The court administers admission rules and regulations of attorneys to the Nebraska State Bar Association along with attorney discipline.
  • The Supreme Court monitors the selection of attorneys to serve on local committees of inquiry and state committees on professional and discipline responsibility.

Supreme Court Justices

Nebraska Court of Appeals


The Nebraska Court of Appeals is the intermediate appellate court. The court consists of a chief judge and 5 other judges. There are 2 panels comprising of 3 judges each in the Court of Appeals.

The Court of Appeals directly handles all cases with the exception of cases related to death penalty or life imprisonment or constitutionality cases rather than forwarding to the Supreme Court.

For cases directly appealed to the Court of Appeals, a petition to bypass is required to be filed with the Supreme Court so as when found necessary by the Supreme Court, the petition will be granted and the case will be forwarded to the Supreme Court docket without first being heard by the Court of Appeals.

Another petition for further review may be filed in which a case that has been decided by the Court of Appeals if found to be unsatisfactory by one of the parties involved, may be re heard by the Supreme Court. The Supreme Court under it own discretion may grant or deny the petition.

Nebraska District Courts


The district courts hear cases related to felony criminal cases, civil cases and equity cases in which the amount in dispute is over $52,000. In certain cases related to various administrative agencies and county court cases, the district courts also operate as appellate courts.

  • Civil cases involving $52,000 and less
  • Preliminary hearings in felony cases

  • Juvenile matters

The separate juvenile courts hear juvenile matters in Lancaster, Douglas and Sarpy Counties.

The county court has a division called small claims court that handles minor disputes in an inexpensive way. The county judge provides the hearings and such courts involve less legal procedures and lawyers may not take part. Small claims court handles cases related to non-criminal civil cases such as disputes over property destruction, money owed, or seeking the return of personal property.

Nebraska Taxation


The Nebraska department of Revenue manages and administers a standard tax laws in the state. Tax laws include entire laws and taxes on income, sales, property, luxury, bingo, and estate. The type of income tax system implemented in Nebraska is a progressive structure in which the tax rate depends on taxable base amount. No sales tax is levied on food and ingredients for home use and not for commercial business purpose. The state income tax is grouped under 4 brackets at 2.56%; 3.57%; 5.12% and 6.84%.
